MemoriCatch is offered through attractions, venues, events, and other business partners. Those partners may also collect or use information under their own policies, and we are not responsible for their practices. Please review their notices where they apply.

2. Information we collect

Information you give us: your name, email address, phone number, billing details and account information; photographs and other images captured or uploaded through the Services; order, payment, download and gallery access details; and any messages, support requests or feedback you send us.

Information collected automatically: device, browser and operating system details; approximate location; IP address, timestamps, pages viewed and other usage data; diagnostic and error logs; and information gathered through cookies, local storage and similar technologies.

Photo access information: guests reach their photo set using the code on their photo card. That code links a photo set to one group's visit. We do not use facial recognition to identify guests across venues or visits.

Information from others: our venue partners, payment and e-commerce providers, and the service providers that help us host, store, secure, analyze and process images.

3. How we use information

We use information to:

• provide, operate, host, support and improve the Services
• organize, retrieve and deliver the photo sets and products tied to a visit
• create themed scenes and other derivative image outputs using automated and AI-assisted processing, including cutting a group out of its background, color correction, sharpening and resizing
• process purchases, downloads and support requests
• keep the Services secure and detect, investigate and prevent fraud, abuse and misuse
• troubleshoot, test, monitor and improve reliability and quality
• communicate with you about orders, access codes, support matters and service or legal notices
• send marketing messages where the law allows it and subject to your preferences
• comply with applicable law, legal process and our own recordkeeping and audit obligations

4. Photos and AI processing

Guest photographs are not used to train general-purpose public AI models. We may use images and related data to improve our own image-processing systems, workflows and quality control, subject to applicable law and appropriate safeguards.

5. Cookies and similar technologies

We and our service providers use cookies, local storage, device identifiers and similar technologies to keep you signed in to your gallery, remember preferences, secure the Services, measure traffic and performance, and support marketing where permitted. Most browsers let you manage cookies in their settings; disabling them may stop parts of the Services from working.

6. How we share information

We may share information with:

• our affiliates and related companies
• service providers that handle hosting, storage, payments, communications, analytics, security, image processing, printing and support
• the venue, attraction or event partner connected with your visit
• payment processors, commerce platforms and fraud-prevention providers
• professional advisors, auditors and insurers
• government authorities, regulators, law enforcement and courts where required or appropriate
• parties involved in a merger, acquisition, financing, asset sale or similar transaction
• anyone else at your direction or with your consent

7. Children and family photos

The Services are meant for general audiences and are not directed at children signing up on their own. Because they are used at family venues, photo sets may include minors. Where the law requires it, venue operators, event hosts, parents, guardians or other authorized adults are responsible for giving the notices and obtaining the permissions needed at the moment a photo is taken. If you believe a child's information has been handled improperly, contact us using the details below.

8. International transfers

The Services are operated from the United States, and information may be processed in the United States and other countries where we or our service providers operate. Those countries may not offer the same data-protection standards as your own.

9. Retention

We keep information for as long as reasonably needed for the purposes described here — providing the Services, supporting purchases, keeping business and legal records, resolving disputes and complying with law. How long that is depends on the type of information, the venue's configuration, contractual terms and legal obligations.

10. Security

We use administrative, technical and physical safeguards designed to protect information from unauthorized access, use, alteration, disclosure or destruction. No system or transmission method is completely secure, so we cannot guarantee absolute security.

11. Your choices and rights

You can ask us to update your contact details, and you can opt out of marketing email using the unsubscribe link or by contacting us — we may still send transactional and service messages. Cookies can be managed through your browser settings.

Depending on where you live, you may have the right to request access to, correction of, deletion of or portability of your personal information, to object to or restrict certain processing, or to withdraw consent. We may need to verify your identity first, and we may decline or limit requests as the law allows.
